Terms of Use and Exchange Transaction Provisions
A. Terms of Use
General
Cryptonow is the intellectual property of Cryptonow Group AG. The trademark rights, products and service platforms are operated exclusively for the Swiss market by Värdex Suisse AG as licensee.
Värdex Suisse AG, a stock corporation with its registered office in Baar, Switzerland (hereinafter “Värdex Suisse”), is the operator of this website and the provider of the services offered thereon.
By accessing this website or using the services offered thereon, the user agrees to the following general terms and conditions (hereinafter the “Terms of Use”) and undertakes to comply with them.
The term “cryptonow” refers, depending on the context, to Värdex Suisse AG itself as well as to its services, products, websites, content and other materials.
Värdex Suisse is not supervised by the Swiss Financial Market Supervisory Authority (FINMA). The voucher amount does not constitute a deposit and is not covered by deposit protection.
It is the responsibility of the user to ensure that the use of this website and the services is legally permissible in the user’s country of residence or stay.
Subject to compliance with these Terms of Use, Värdex Suisse grants the user a personal, non-exclusive, non-transferable, non-sublicensable and limited right to use the website and the services offered.
1. Cryptonow Gift Cards and Redemption of the Balance
1.1 Värdex Suisse issues physical and digital gift cards which may be purchased from authorised points of sale. The gift card constitutes a prepaid value card and is comparable to a gift voucher. It is linked to a printed, initially empty blockchain cryptocurrency wallet.
1.2 The gift card contains a balance in fiat currency (e.g. CHF or EUR), which may be used exclusively for the purpose of exchanging into cryptocurrencies via the platform www.cryptonow.ch operated by Värdex Suisse.
1.3 The holder of the balance and the party entitled to activate and use the cryptonow gift card is exclusively a natural person. The activation or use of the gift card by or on behalf of legal entities, partnerships, trusts, foundations, associations, institutions or other legal constructs is expressly excluded.
1.4 Activation requires the prior purchase of a physical or digital cryptonow gift card.
1.5 The balance on the gift card may be used exclusively for a single, complete exchange transaction. Splitting the balance into partial amounts is excluded.
1.6 Cash payment of the balance, return of the gift card or exchange into other vouchers is excluded. The balance does not bear interest.
1.7 The balance on the gift card expires twelve months after the date of purchase. For specially marked promotional gift cards, the shorter validity period printed on the card shall apply.
1.8 Värdex Suisse reserves the right to suspend the activation of gift cards temporarily or permanently in the event of technical disruptions, maintenance work, security incidents or suspected cases.
1.9 The gift card may be transferred as a gift. Värdex Suisse assumes no liability in the event of loss, theft or damage. Replacement is excluded.
1.10 Commercial trading in cryptonow gift cards is prohibited. Värdex Suisse reserves the right to exclude persons who violate this prohibition from further use.
1.11 By activating the gift card and carrying out an exchange transaction, the customer expressly declares and confirms that all funds used are exclusively the customer’s own personal funds, originate from lawful and legitimate sources, do not derive from criminal activities, money laundering, terrorist financing or other unlawful activities, and that the customer is acting neither in the name nor for the benefit of a third party.
Värdex Suisse reserves the right at any time to reject or suspend transactions in the event of suspicion, to temporarily or permanently block vouchers where a suspected case exists, and to submit reports to the competent authorities in accordance with applicable legal provisions.
2. Data Security and Data Protection
2.1 Värdex Suisse processes personal data in accordance with applicable data protection regulations and exclusively for permissible purposes.
2.2 The user consents to the processing and disclosure of their data to third parties insofar as this is required or permitted by law, in particular in the context of anti-money laundering obligations.
2.3 Anonymised data may be used for statistical or marketing purposes.
2.4 Third parties who obtain access to personal data are contractually obliged to comply with equivalent data protection standards.
2.5 During card activation, personal data may be processed. The user expressly consents to such processing.
2.6 Appropriate technical and organisational security measures are employed.
2.7 No absolute guarantee can be given for the security of data transmitted over the internet.
3. Third-Party Links
Värdex Suisse assumes no responsibility for the content or services of external websites. Access is at the user’s own risk.
4. Intellectual Property
All content on this website is protected by copyright. Any use not expressly permitted is prohibited.
5. Liability
5.1 Värdex Suisse assumes no liability for interruptions, delays or technical disruptions of the services.
5.2 The gift card holder confirms that they are the lawful owner of the balance and that no third-party rights are infringed.
5.3 Liability for indirect damages, financial losses, loss of profit or loss of data is excluded to the extent permitted by law.
5.4 Värdex Suisse assumes no liability whatsoever for the loss or damage of private keys of crypto paper wallets.
5.5 Any issued crypto paper wallet is intended exclusively for temporary use. Cryptonow paper wallets do not constitute a secure or permanent custody solution.
The customer is obliged to transfer the acquired crypto assets immediately to their own wallet under their exclusive control.
Värdex Suisse assumes no liability for damage, loss, theft, illegibility, compromise of the private key or loss of value of the crypto assets. Use is exclusively at the customer’s own risk.

Customer service is available by telephone or online.
B. Exchange Transaction Provisions
By carrying out an exchange transaction, the user accepts these exchange transaction provisions as well as the Terms of Use.
7. Process and Conditions of the Exchange Transaction
The exchange transaction is carried out in accordance with the process displayed on the platform and, once confirmed, is binding and irrevocable.
8. Crypto Transfer and Paper Wallet
8.1 Following completion of the exchange transaction, the cryptocurrencies are transferred to the wallet linked to the gift card.
8.2 Blockchain-related delays may occur.
8.3 Transfer to other wallet addresses is excluded.
8.4 The user bears sole responsibility for the secure handling of the private key.
9. Exchange Limits and Thresholds
For gift card activations, a limit of CHF 1,000 per person within a period of 30 days applies; for cashless transactions, a limit of CHF 1,000 per person per day applies. These limits are implemented in accordance with the applicable Swiss statutory provisions and the corresponding ordinances. Värdex Suisse applies appropriate system-based controls, monitoring mechanisms and limit checks to ensure compliance with these requirements.
In the event of any suspicion, or where required to comply with applicable legal or regulatory obligations, Värdex Suisse reserves the right to refuse transactions, suspend services, or block users, and to take any further measures required under applicable law.
10. Exchange Reference Price
The exchange is carried out at the reference price applicable at the time as determined by Värdex Suisse. Market fluctuations may result in deviations.
C. Final Provisions
11. Amendments
Värdex Suisse reserves the right to amend these terms at any time. The version published at the relevant time shall be authoritative.
12. Severability Clause
Should any provision be invalid, the validity of the remaining provisions shall remain unaffected.
13. Jurisdiction and Applicable Law
Swiss law shall apply exclusively. The place of jurisdiction is Baar, Canton of Zug.
